You've asked them for an assessment under section 42 of the DPA.  The
purpose of such an assessment is to determine "whether it is likely or
unlikely" that the processing was in compliance with the Act.  So when
they reply that they are "unlikely" to have complied they are merely
applying the statutory test that you have asked for.
