This all comes back to common sense.  If you explain to me what is happening
then I will co-operate with any reasonable efforts you are making and will
not complain.  Equally, though the 40 days is a legal absolute, TICO has
better things to enforce than someone who is explaining why certain things
are not happening within that 40 day period.

We supply all that we can as soon as we can.If it's a particularly
contentious case we start the ball rolling before we have the form returned
with the fee. We wait until we have as much data as possible and send it all
out together.
If it looks like it's going to go over the 40 days for some data - 3rd party
consent to obtain  or whatever, we write to the Data Subject explaining this
and the reason why. Once a  Data Subject came back and said 'What about my
data in such and such department'. We supplied this with a suitable
apologetic letter.
