I agree with you. I see notification of processing purpose plus consent as intrinsic to the process -----Original Message----- From: This list is for those interested in Data Protection issues [mailto:[log in to unmask]] On Behalf Of Donald Henderson Sent: Wednesday, September 08, 2004 9:14 AM To: [log in to unmask] Subject: Re: [data-protection] Fingerprinting schoolkids Aren't you forgetting that we have a responsibility to ensure that all eight principles are applied properly ? In a case like this, we want to be making sure that that the system and its information is secure, that the purpose of holding the data is clearly defined and well understood, and that retention / destruction of the information is done timeously and properly. Sometimes I think we focus too much on problems (and there are many !) and stopping people doing things. Part of our jobs has to be finding ways of getting things done..... It always "looks reasonable". I have never agreed with that position. It is the argument I attack, not you, Donald. To me it looks firmly as though the purpose of the processing was not made clear (and if of primary age then the child is unlikely to understand the implications of the processing anyway), and as though consent was absolutely necessary for this form of processing. Oh yes. As one of those with nothing to hide, and thus nothing to fear, what *do* I fear? The answer is any minor indiscretion that anyone could hold against me. The bus I forgot to get a ticket on when I was 22; the paperclip I took form the office and used on a private letter; the phone call I made on private business; the *friends* I associate with ("are you now or have you ever been a communist?"); the fact that I never went to Dorset that day, instead I was miles away doing something else; the school library book I never returned, and the fact that my fingerprint is now on a database somewhere as a defaulter or possible thief; that someone has made a simple mistake, and I am persecuted for the deeds of some other "Tim Trent"; etc -----Original Message----- From: This list is for those interested in Data Protection issues [mailto:[log in to unmask]] On Behalf Of Donald Henderson Sent: Wednesday, September 08, 2004 8:33 AM To: [log in to unmask] Subject: Re: [data-protection] Fingerprinting schoolkids [snip] Was consent necessary ? Definitely debatable - lack of consent could be taken to prejudice the education of the child (since they wouldn't be able to get books out of the library) [/snip] ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^ All archives of messages are stored permanently and are available to the world wide web community at large at http://www.jiscmail.ac.uk/lists/data-protection.html If you wish to leave this list please send the command leave data-protection to [log in to unmask] All user commands can be found at : - http://www.jiscmail.ac.uk/help/commandref.htm (all commands go to [log in to unmask] not the list please) ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^ The information in this email is confidential and is meant solely for the intended recipients.
