I agree with Tim.

Of course, there is one very simple way to solve this - ban the sale of
cameras!  Sure innocent parents would lose out on those precious pics of
their darling sprog's embarrassing appearance in the Nativity play, but it
would *totally* eliminate that 0.1% chance of some old perv taking his
picture too!

I'm sure we are all trying to be helpful and find a justification for
stopping filming under DPA, but of course this is not actually a decision
based on DPA at all. It stems from child protection and the fact that the
"father" at the back with a video camera may be a paedophile and no one is
prepared to take the risk.

Surely this is straightforward isn't it?

If the school is taking photos/video for use in publications (electronic or
otherwise) then it must do so within the bounds of its entry in the register
as a data controller.

A parent etc taking photos/video of the schools concert is acting as a
private individual and S36 rules (the fact that the images will be used to
embarrass the child in later years to the great amusement of his/her
contemporaries is immaterial).
