Hi Dor It seems to me that there should be an Absence Management (or whatever) policy which should say what the records are kept for and/or how long they will be kept, which should be the subject of collective agreement or otherwise incorporated into the contract of employment, possibly with clauses/riders about how it interacts with other policies. That should settle it unless there were some flaw or abuse in the provisions. If there isn't a policy ... well, what are they kept for?!
