Introduction
UK copyright law states that any piece of original work is automatically
copyright protected as soon as it has been recorded in any way - on paper,
in an audio recording, on film, or electronically. An idea itself is not
copyright protected - it is only the expression of it that is.

Copyright legislation (Copyright, Designs and Patents Act 1988) predates
the
Internet. It's in sore need of a revamp, but by someone with the
technical
ability and vision to do a good job (people of this capacity generally
find
more worthwhile things to do than be politicians!).

What we can do is ensure that all 'original' material that is produced
in
our colleges is given a sensible copyright that reflects how we want to
be
able to use it. You may wish to make it a condition of acceptance for
online
materials, that it may be copied freely within the college as a bare
minimum... preferably that it may also be shared with other educational
institutions. Naturally, an author's name should always be associated
with
the materials that he produces... all the pages on our VLE have a 'Page
content: <Author Name>' tag at the bottom of the standard template
(along
with a 'last update' date...).

We cannot do much about external 'dinosaurs' who wish to remain in the
paper
age, apart from keeping on asking them to make materials available...
and
ultimately to leave them behind where possible and use resources from
more
enlightened individuals.

Of course people should keep in mind that copyright legislation applies
to
all published material and that any digitisation of books/journals does
require permission from the copyright holder.  It would always be
advisable
to check with the rightsholder if digitisation is allowed (and if they
wish
payment for such use) as some rightsholders may be willing to give
permission for paper copying but not digitisation.

I'd also add to that that just because a publisher has not made specific
copyright statements in the work related to what you want to do with it,
does not mean that it is permissable.  Even if the material is being
used
for educational purposes, rightsholders will more often than not wish to
be
paid for your use of the material.

Obviously, an article from an external source can only appear on your
College intranet/VLE if whoever wishes to put it there has obtained any
necessary clearance from the copyright holder. You'd need to look at the
precise wording of the copyright statement. Of course, most do not get
so
specific, and make the resource available 'for educational use' or to
(particularly if a payment has been made) the college in question
without
getting specific about '1st year of AVCE Science' or whatever.

Materials written by members of the college in the course of their
employment are normally regarded as being copyright of the college...
although this is always a grey area as many teachers are quite
possessive
about anything that they have written. However, if they have taken the
step
of making it available to members of the college by releasing it to the
Intranet/VLE, then I wouldn't see a problem in making it available to a
wider audience WITHIN the college - unless the author gets particularly
'precious' about it.

If you mean a published article then is there need to get copyright
permission to post multiple copies - or even the first one?
