Dear Arthur, As far as DPA is concerned it only relates to a living individual, therefore if the person in question is deceased, then they do not have any legal rights under DPA.....though this does not mean that they do not have rights under some other legislation. A relative of a deceased person has requested copies of the Social Services file - should we supply ? should we edit? Should we insist on a court order? My initial concern is the distress the contents may cause along with subsequent legal actions for whatever reasons plus all the normal DP problems of disclosure (3rd party etc)..
