The DoHs guidance on this is available at: http://www.doh.gov.uk/consent/praguidance/index.htm I have personally dealt with one "patient" who I told the police was feigning unconsciousness and who because he could/would not give consent to a sample got off. This may in certain circumstances be a good thing but personally I would want the FME to do it.
