A letter of formal notice was sent by the Commission to France for non compliance on 20th March 2002    (IP/02/446)

After this a 'reasoned opinion' will be addressed to France and if non compliance continues then the Commission may apply to the Court of Justice to impose a fine.  The Court is free to decide the level of fine and is not bound by any amount suggested by the Commission  (Article 228 of the EU Treaty).    It could be a lengthy procedure.

There is also a case by the NFU vs the French Government C-241/01 currently proceeding through the Courts on this same matter.

Dear all

I've had a request for information on the procedure currently being gone through to overturn the France's ban on UK beef imports and the current state of affairs.

I have found some limited information on DG Health & Consumer Protection's Food Safety webpage and nothing that specifically mentions the French ban on DEFRA's website.

Any other suggestions would be gratefully received.
