After a little research, here are my conclusions: There doesn't seem to be any regulatory requirement to publish ECSC decisions taken under Article 66 of the ECSC Treaty. There was a Commission notice on aligning procedures for ECSC mergers with the EC Merger Control Regulation. OJ C 66/1998 and web version http://europa.eu.int/comm/competition/mergers/legislation/mergin98.html. This provided for publishing a notification that a case was under consideration but made no provision for the decision. When you look at ECSC cases on the Competition web site, you get references to those notifications. The only texts I have been able to find for strict Article 66 cases are press releases on RAPID. This implies that the decisions have been addressed to the parties concerned and the Commission is unlikely to release them as they have not been vetted for confidential business information. On the other hand, some ECSC cases have been treated primarily under the Merger Control Regulation.
