For what it's worth, the following is the official view of the Scottish Executive on the role(s) (Taken from An open Scotland 6.11).....
 "In summary, it is proposed that most personal information will be excluded from the provisions of the Scottish Freedom of Information legislation. The majority of applications for personal information will be handled under the Data Protection Act 1998 and will therefore be subject to enforcement by the Data Protection Registrar (or the UK Information Commissioner when the roles are combined). We would expect that where issues at the appeal stage relate to the protection of personal information, the Scottish Information Commissioner would liaise with the Data Protection Registrar/UK Information
Commissioner. We will consider the most practical means to ensure that such liaison would be carried out effectively."

I believe we will be getting an Information Commissioner but as in England I
think they should have a dual purpose to include Data Protection as well.
As I have said on previous occasions, Scottish Law differs in many ways to
England and Wales especially in relation to Social Work (Social Services in
England & Wales) and Education.  The ODPC cannot advise on the
interpretation of the Education/Social Work part for Scotland - that is not
part of their remit.  I am still awaiting documentation from the Scottish
Office re. Social Work.
