RE: Retention Periods within Social Services

Yvonne,

I've reproduced an extract from the Social Services guidance for the DPA 1998 on the Dept of Health web site. It's available as a downloadable PDF file.

http://www.doh.gov.uk//scg/datap.htm

Our regional archivist has done some research on this. If I get any additional information, I will post it here.

Allan

The following records are subject to statutory requirements:
* Case records relating to children who have been placed, to be retained until the
75th anniversary of the child's birth or for 15 years after death if the child dies
before age 18 (Arrangements for placement of Children (General) Regulations
1999).
* Records relating to a foster parent or other person and any entry relating to
him in a register must be retained for at least 10 years from the date on which
his approval is terminated or until his death, if earlier (Foster Placements
(Children) Regulations 1991).
* A video recording of a child witness made under the Criminal Justice Act 1991
must be retained for so long as it may be needed for the purpose of a trial or
appeal. The decision to destroy it must be jointly by the Director of Social
Services and the senior police officer concerned (Code of Practice for Video
Recorded Interviews with Child Witnesses for Criminal Proceedings 1991
(paragraph 3.14)).
* Registered Residential Homes are required to keep records for 3 years after the
date of the last entry (Registered Care Home Regulations 1984, Regulation
6(4)).
* Registered Nursing Homes are required to keep case records for not less than 1
year after the date the individual ceases to be a patient in the home. But the
Mental Health Act 1983 requires records to be kept for 5 years after the date
the person ceases to be a patient in the home (Nursing Homes and Mental
Nursing Homes Regulations 1984, Regulations 7(6) and (10)).

Subject: Retention Periods within Social Services

Has anyone within the group got any links/advice on standard Retention
periods?.
I understand that there is a brief section on the commissioners site on
basic administration/finance, but what about database management?
Also a specific area of interest is within social services, how long have
they been working with the current standards and does anyone know where the
information comes from origionally? (I need to get an idea of how long and
under which legislation they 'should' or have been working with). I
specifically need to know the standards with manual records such as Diaries
and recommendations on the use of e-mails (with the introduction
of 'handhelds'forming a new form of diary). Are there any guidelines on
retention for this manner already in use ?
