Neil This has been an issue within the West Midlands area for some time, The West Midlands Local Authorities Data Protection Forum are currently looking into this issue. I'm currently looking at the 29(3) disclosure form used by our local force, with an aim to making more friendly to the data controller. This could also apply if a CCTV operator witnesses a crime on screen and reports it to the Police who then ask for the tape. A second question on the same subject: what would you do if a Police officer presented the necessary exemption certificate but then asked for data that you can not readily see has a bearing on the case, even though it relates to someone you know is under investigation? Any opinions on these questions would be greatly appreciated.
