Waterstone's approached us (and many other universities, they told me) during the summer to set up affiliate links from our site. We were quite happy to do this, but a little put off when they sent us several pages of legalistic agreement. Buried in there were two clauses that we particularly disliked: 1. A Blackwell's-type exclusivity commitment, which Waterstone's agreed to remove. 2. Far worse: a clause that meant either party could only withdraw from the agreement after six months' notice... Our interpretation of JANET AUP is that discreet affiliate-type links on our website are okay, but if that turns out to be incorrect, or if the AUP changes, Waterstone's agreement potentially left us in a position where for six months we would be contraveneing one agreement or another! We're still discussing this with Waterstone's but won't sign up on these terms.
