Explicit consent to process is given by the applicant signing a declaration stating ' I give my consent to the processing of my data by UCAS and educational institutions.' This data is not included in the HESA return. With regard to the legal position regarding institutional liability, I would just say that UCAS switched from a statement about omission of material information, including criminal convictions, to a positive yes/no box as the result of a very serious incident on a university campus.
