Doreen, You're perfectly right. Whereas the whole of the Access to Personal Files Act is repealed, parts of the Access to Health Records Act remain in force. This is due to the DPA 1998 only applying to living individuals, whereas the Access to Health Records Act also contains provisions relating to deceased persons.
