Whether there should be no claim and whether there is a legitimate claim
are two different thing.
Disabled people are repeatedly subjected to 'quality of life' assessments
when presenting with treatable illneses such as chest infections. The
treating practitioners may have little or no knowledge of disability issues
or the normal life of that sick individual, but the status of Doctor gives
entitlement to act without regard to these issues.
Equally the Health service is not organised to deal effectively with A&E
admissions of people with any form of communication difficulties and
ignorance can lead to poor or no appropriate treatment.
The NHS is no more above disableism, racism, sexism etc than the society in
which it operates, BUT more power is held by NHS practioners over the lives
of others than most prejudiced people in the wider society.
