As Kriss says details are unavailable, so I'll refrain from comment on
the actual judgement, but the key bit of the statement, to my mind, is
"it had not taken reasonable care"
We are ALL at risk unless we can *demonstrate* that we are taking
reasonable care. I'm not sure what this requires in any absolute sense,
but some good starting points might be:
1 - AUP/Rules/Guidelines made readily available to all users
2 - Established policy for dealing with misuse
3 - documented instances of dealing with past incidents of misuse
I think the latter might be quite important since with the proliferation
of freeserves etc. the powers that be may (should?) be concerned with
the ability or inclination of service providers to enforce the signup
agreements.
