My assumptions are as follows:
the Education (Student Support) Regulations 1999 cover new students
in 1999/2000 and those who started in 1998/99 (who are not
exceptionally treated as if they had started courses in 1997/8).
These students will all, therefore, be subject to the one year 'false
start' regs.
'existing' students will still be subject to Mandatory Awards
regulations. I am not aware that there is any intention to make any
changes to these so such students will still only get the 20 weeks.
This presumably includes those who are classed as 'existing' because
they were gap year students or one of the other exceptions.
