Just to clear up a confusion I may have created by my
previous e-mail, I ought to point out that although post-October
1998 processing comes under the terms of the new 1998
Data Protection Act, the necessary Statutory Instrument(s)
required to bring the Act into full force have not yet been
introduced, and are unlikely to be introduced until at least
June 1999.
This means that apart from various definitions paragraphs and
the sections on the introduction of notification and fees
regulations, the new act is NOT yet in force. We are therefore
in the daft situation of still having to register any new
processing or renew existing register entries under the terms
of the 1984 Act, using the forms, purpose descriptions, sources,
disclosures etc relating to that Act, NOT the new Act.
Whether any amendments made now to existing register entries,
or any new entries made now relating to post-Oct 98 processing
will then immediately come under the terms of the 98 Act once
it does come into full force later this year, I'm not too sure
about! I got the impression from the DPR telephone information
line that amendments made now will then be valid until the
entry runs out or on 23 Oct 2001, whichever is sooner.
