It's a term of convenience with no real legal meaning. Usually used
for drugs which are unlicensed but available for (usually) small
numbers of (named) patients. In some cases, this may be as a result
of pressure to make a new drug available prior to its
licensing/launch. May also be for a rare disease, e.g. alglucerase
for Gaucher's or a drug which has been around for some time and/or
widely used outwith the UK, e.g., oxybutynin for urinary
incontinence (both have now been licensed for some time but were
hitherto available for *years* ).
Legal liability is no different from other unlicensed medicines,
i.e.,you may be at increased liability in the event of a mishap.
