I was idily chatting to a solicitor yesterday and he was saying that the only
way that the proposed nurse run NHS 888 line could legally cover itself was by
ending all advice on medical matters with the well-known phrase "if you are
really concerned, then you should contact a doctor" or something like it. Some
of his colleagues are rubbing their hands with glee at the thought of
litigation over the first 'late' diagnosed meningitis. He thought that
otherwise the courts would have to decide that this new role for nurses was
reasonable, reasonably safe and that their employers (?DoH) would carry any
legal cost consequences. The nurses might have to be separately insure
themselves as well. I can't see it happening under those circs. Comments,
especially from legal lurkers (just who might that be?)
