A very difficult one. However I feel that as there is obviously the safety of
others to consider and you have made a clinical diagnosis, then you are
probably OK. Did you inform her of the access to medical reports legislation.
Informed consent would require her to understand that she had the right to see
any report before it was sent. If you have a signed consent stating that she
understands the relevant legislation there is no doubt that you are in the
clear, even if she did no know what she was signing. On the other hand, if you
do not have written consent or did not explain the act, then the information
you have gained may have been released without her agreement.
