only until it is overwritten surely?

That, of course, is unanswerable, and despicable :-(
The access to premises is always a problem, of course, but the ISP data,
IMHO, should be inviolate without a court order. It probably is, as far
as the major ISP's are concerned, but I wouldn't bet on some of the
smaller, and foreign ISP's keeping their data inviolate in the face of a
possible fine.
