my initial thoughts were
* the sleepers are a waste, as they "require to be discarded"
* and just be cause something has a "value" doesn't mean it is not waste, (as waste can be traded / bought & sold e.g. scrap metal.
* and "waste" only ceases to be a waste when it is "fully recovered"
so the question I have is then when do materials (e.g. surplus timber & sleepers / slates / pipeworks etc) that have an architectural use in their existing form cease to be a waste and how do we transfer these (via duty of care) to a person, say an architectural salvage yard.
It appears there man be a "U8 exemption Waste exemption: U8 using waste for a specified purpose" that may be of assistance -
This exemption allows you to use waste that does not need treating, to reduce the use of virgin or non waste materials.
