Hoping that someone can help me with the following request,
Could anyone direct me to anywhere in the Equality Act 2010 where it suggests that OH review pre-placement health questionnaires,

One caveat. For IHR it is expected/good practice to have up to date medical evidence from the treating doctor/specialist. Cases are frequently overturned without it.

If it was to later transpire that the report was being commissioned for this reason, and the employee did not know this, then they have not really given valid consent for this. Please correct me if I am wrong though.

Hi Lucy
I would say that we should never request a further medical evidence report without assessing the individual, regardless of whether they are having a final hearing or not. I don't believe we would be part of the formal attendance management review/stage 3 final hearing?
We wouldn't know what specific questions to ask or what type of FME to get if we hadn't recently assessed the person.
Usually we will be advising whether that individual is able to return to work in the reasonably foreseeable future and whether any adjustments or redeployment is feasible to assist the return to work
