“By submitting this form, EUI members certify that the dataset for reposit is the result of original data generation; or is the output of significant, value-added, elaboration of pre-existing sources.” And: “By submitting this form, EUI members certify that their work complies with the Code of Ethics in Academic Research of the European University Institute.”
There follows a paragraph on data protection and database copyright (the latter is particularly important if submitters have part-sourced their 'mixed' datasets from library-licensed resources).
Overall, it is not just RDM staff who (as you write) “are not necessarily qualified or resourced to certify that the dataset is suitable for archiving or sharing.” This applies even to academic staff – who would need many hours to carefully ascertain quality/legality (even in their own discipline or sub-discipline) if asked to do so.
Data 'peer review' is thus – for the most part – post facto.
In our presentations to doctoral students, we always emphasise data protection and data-source copyright. We also caution submitters that – although there are clear and positive upsides to data sharing – there are serious reputational downsides to exposing sub-standard or poorly-made datasets.

Hello,
This is a request for anyone willing to share wordings for deposit indemnifiers.
At Glasgow, we offer a mediated deposit service for research data sets. This means the final deposit is done by a member of the RDM team, but we are not necessarily qualified or resourced to certify that the dataset is suitable for archiving or sharing. Has anyone developed a form which the academic needs to sign or acknowledge to assert that the data is suitable for sharing, that they're willing to share?
