What is it? – Data Protection Bill
The Data Protection Bill will repeal the Data Protection Act. Together with the EU General Data Protection Regulation (GDPR), it will govern data protection in the UK including personal data in manual records held by FOI bodies. The bill includes exemptions for archiving in the public interest from some of the duties contained in GDPR.
When is it happening?
The draft bill has been published today (https://publications.parliament.uk/pa/bills/lbill/2017-2019/0066/18066.pdf) and will now be considered by parliament. GDPR will automatically become UK law from 25 May next year.
What will be the impact for archives?
Where possible, the government is reproducing existing exemptions and safeguards although there are some changes from the Data Protection Act (there is no longer a fee for subject access requests as an example). Further processing for archiving in the public interest and historical research purposes is permissible subject to similar conditions in the Data Protection Act. The exemptions (derogations) from GDPR for UK archiving and research are at clauses 18 and 22-3 and schedule 2 part 6 in particular.
What should you be doing?
This is an evolution of data protection law not a revolution so archive services should review their services and processes to ensure they will be in line with GDPR and the bill pending its full approval by parliament. You can check the ICO website https://ico.org.uk/for-organisations/data-protection-reform/ for more information and if relevant, contact your data protection officer so they are aware of your archival processing for implementation planning.
