A new General Data Protection Regulation will come into force in May 2018, effectively replacing the existing Data Protection Directive which is implemented in the UK through the Data Protection Act 1998. This timetable will not be affected by the current process for the UK to leave the European Union.

As with the existing Directive and Act, the Regulation contains a number of provisions potentially exempting historical archives and research from certain aspects of its operation.
Colleagues at DCMS have just issued a call for views on UK implementation of the General Data Protection Regulation, in particular those parts of the regulation where derogations (exemptions) in UK national law are permitted including the potential derogations in relation to archiving in the public interest and research (at page 8). The National Archives continues to work with DCMS and other UK government colleagues on the derogations and other issues relating to UK implementation.
