Hi all, sorry to return to this age old subject, but does anyone have any experience or clear guidance on publishing images under fair use once you have been explicitly denied permission?
I want to include two (single panel, black and white) images from Arkham Asylum in an article (in edited collection on Gothic lit, from academic publisher Peter Lang, both images will be discussed closely).
DC have said no outright (I suspect because they keep Arkham in print) which is making the publisher reluctant to go for it under fair use... anybody have any experience here? Are DC in the habit of suing people??
