I dealt with an instance of the issue you describe in scenario 1 earlier this week, where a student contacted our IT Service desk to request support because she was unable to view the feedback on her marked Blackboard assignment. Not only was the 'Feedback to user' text unavailable, but also annotations on the marked script itself. I was able to identify 2 other marked submissions to the same assignment where the same issue had occurred, as I found that although they had been marked and an override grade entered, they still appeared in the 'Needs grading' area of the Grade Centre. To rectify the issue I opened each affected submission, clicked into the Attempt grade field, then submitted again without making any changes.
I've replicated the issue in a test module, but haven't yet found any way to prevent it from happening. Like you I have also found in testing that it's possible to have a different grades in the Attempt grade and the Override grade - and it seems that the override grade is always the one that will show in the Grade Centre, no matter which was entered most recently. I would also be very interested to hear of any ways of identifying the problem and preventing/resolving it that others have found.
