In the letter to Defra the CIEH stated: ‘If it is now the government view that contamination is a lot of fuss about nothing, it should amend the 1990 Act and relieve local authorities of the duty it has now made impossible to discharge.’ 



There are some beautiful words available in other languages such as in Bengali language there is a word in transliteration known as "Abhimaan". The meaning is "it is a word to describe a degree of upset/grudge you hold against a loved one or someone you are close to."

This is my take on from CIEH statement.



In my view contaminated land problem will always remain as a problem. Current industrial activities become a new history for tomorrow, which next generation regulatory authorities and CL specialist need to be dealt with.  "Depth" of problem might be reduced because of current good practice using best practicable mean, but "breadth" of problem will remain. So, there is no need for the amendment of EPA 1990 Part 2A.



In my view, it is the local levels (in some cases) who do not feel that this is a priority area rather identify other areas of priorities according to their skill, knowledge and understanding. If a Finance Officer becomes a Head of Environmental Pollution Department, then I must say that problem, at the first place, lies with the organisation itself. So, local level should put forward their case in a robust manner, so that their voice can be heard. But, this can only happen, if right people do the right job.

Think CIEH might have gone a bit too far here.  Generally I think where there's a will there's a way.  For example if Council's reduced the amount of money wasted through, for example, being charged unnecessarily on Council development projects, they could perhaps use the (quite often substantial) savings to fund investigation works under Part 2A.  



Without trying to be controversial, and considering that these days contaminated land needs to be considered in context with other lifesaving services in the Council, it could also be argued that the current situation prevents all but the worst sites being addressed and that if the worst sites aren't being dealt with this says more about the priorities of the particular Council.



I am a die-hard contaminated land person (I promise)  but also remember the days when sites where determined by some because they exceed SGV's - could we be in the midst of a backlash?  It would be more useful if the CIEH could fight our corner by focussing on what is needed by Council's to address the sites that truly do need work.
