For those not yet aware, DCLG are proposing significant limitations to planning conditions and the requirement to agree any pre-commencement planning conditions with the applicant. This has the potential to significantly impact upon achieving remediation of contaminated land under the Planning Regime.
I feel that the importance of contaminated land conditions and the fact that they are pre-commencement by nature of the process required to effectively identify contamination and make land suitable for use needs to be highlighted. The alternative is to require the land to be risk assessed and remediated up front which developers often argue is not economically viable.
I would encourage contaminated land officers and others interested to respond to this consultation.
