Would appreciate your thoughts on one of my conundrums ...
Am thinking about consent under the GDPR (explicit, freely given etc) and the way we gather consent in the future to comply with the Regulation.
What I'm struggling with is that when an individual signs up to a new tenancy with us they currently sign to say that they know their data will be processed in order to manage their tenancy and may be shared with a select few organisations with regard to certain functions, such as local authorities regarding Council Tax etc and consent to this happening.
Under the new GDPR surely this consent will not be freely given as we require them to give consent in order to manage their tenancy with us. If they withdrew their consent then we wouldn't be able to process the tenancy therefore it isn't really an option. We had a tenant years ago who said he withdrew consent for this and when I spoke to the ICO helpline at the time they said that he couldn't really do this as we wouldn't be able to process his tenancy so it wasn't practicable and there was a "reasonable expectation" that we would process his data re his tenancy. He felt we were being fair and transparent which was the purpose of the Act.
How can we obtain freely given consent in this instance to comply with the GDPR - or am I missing something (always possible!).
