The huge elephant in the room with most access deficiencies in new public buildings is lack of enforcement of AD M by building control bodies and approved inspectors.
I attended an 'Inclusive Design in the Built Environment' event in Cardiff earlier this year put on by the Design Council for Wales, Royal Society of Architecture in Wales, Constructing Excellence Wales, RTP Cymru and Welsh Government. It was excellent, well attended and informative but on leaving the venue (a new hotel) I visited the toilets and was surprised that there was no unisex wheelchair accessible toilet for independent use in the toilet area which is a building regulations requirement. There were separate facilities in the male and female toilet areas which were under sized and also would not have allowed a helper of the opposite sex to assist. For instance I was sat near a gentleman from Guide Dogs Association and his assistant was female. It would not have been possible for his assistant to direct him to the accessible cubicle with his dog without entering the male toilet area. There were also issues with the front entrance in terms of manifestation and signage.
Many of the photographs used to illustrate poor access at this inclusive Design event were of fairly recently completed projects and it occurred to me that the elephant in the room was the lack of enforcement by building control bodies of AD M. I have noticed that building control bodies still consider Part M as discretionary or something that can be compromised instead of enforcing it with the same vigour as all the do with the other approved documents. This is leading to many, many new buildings not being fit for purpose in terms of access and use. The building regulations used to be seen as the light at the end of the tunnel for disabled people in as much as it was expected that at least all new buildings would be accessible because building regulations are (should be) enforced by statute. Whereas ensuring access to existing buildings is much more complex. For many disabled people this light has now been turned off because of the lack of effective enforcement with building control bodies.
I contacted the organisers pointing this out and asked them to consider developing training for building control bodies on this issue.
They have promised to raise this with higher authorities. So don't hold your breath...
