I have to sit in HR in one of my contracts, I just have to ensure that if I need to discuss anything I go into a private room and I shield my emails / computer screen so no one can see. It is awkward at times, but we manage.

I suspect that you might have a case but would recommend that you seek specialist legal advice. If you are a member of the RCN they should be able to point you in the right direction.
