- ‘Bottom-up Salvation? Institutionalised Practical Cooperation in EU Asylum Policy’

The successful completion of the second phase of legislative harmonisation in the EU asylum policy in June 2013 was heralded as a historic achievement. However, it was already recognised that the ‘achievement is not yet fully complete’. Indeed, a mere two years later, the EU finds itself in the midst of what has been termed a ‘refugee crisis’ and unable to effectively handle the increased arrivals of asylum seekers.
Against this backdrop, this research assesses the role and contribution of the European Asylum Support Office (EASO), a relatively new EU agency, in the European asylum policy. EASO is tasked with coordinating practical cooperation efforts so as to achieve harmonisation “bottom-up”, namely through the harmonisation of practices. Although it does not have the power to issue binding guidelines or recommendations, its various support activities have the potential to increase Member States’ capacity in effectively implementing this policy. Tasked with supporting Member States ‘subject to particular pressure’, the agency has been called to play a key operational role in the running of the so-called ‘Hotspots’. The research focuses on a legal analysis of the agency’s mandate and governance structure, while examining key activities that have been undertaken by EASO to realize its objectives. In light of discussions of further reform of the EU asylum policy, it comments on initiatives that could be envisaged in the future under the agency’s mandate.
Bio: Lilian is an RLI Doctoral Affiliate finalizing a doctoral project on the administrative governance of the EU asylum policy, supervised at the Law Faculty/Institute of European Studies of the Université Libre de Bruxelles (ULB). She is a researcher at the Université Catholique de Louvain (UCL) and a visiting researcher at the Law Faculty of the European University Institute (EUI). A member of the Odysseus Academic Network coordination team, she regularly consults for the EU institutions, international and non-governmental organisations. Lilian has authored a number of articles and book contributions in the field of refugee and asylum law.
