I'm not sure I would necessarily characterise it as "silly", although I'd certainly accept that implementation is problematic. It seeks to address a serious privacy issue, however.
Might be worth looking at the recent action taken by CNIL and the Belgian DPC against Facebook: https://www.cookielaw.org/blog/2015/12/3/facebook-concedes-to-cookie-ruling/. CNIL has also taken other action in recent months.
