Hi,
Surely this is down to whether you have a contract, SLA's, insurances etc in place for the new company.
If someone refuses the transfer of records from one provider to another it does not prevent you from completing the required Health Surveillance that is due to them under COSHH and Management of Health and Safety at work.
Just my opinion.

Hi Tracy,
As far as I am aware The Faculty of Occupational Medicine in the Guidance of Ethics (2006) advises that were records are transferred to a new occupational health provider (in house or outsourced) the records will normally be transferred. It advises that individual subject consent is not necessary, but the employees should be informed and given reasonable time to object to the transfer. Therefore on that premise it would not be legal to work for a company until the transfer is complete.
