That's a good one. The new code of conduct has a section on this as well as the physicians guidelines.
My stance is that anything that is pertinent to auditing the decision making pathway needs to go in the notes as well as what information had been exchanged about the employee relevant to their case.
The Data Protection Act will be very helpful as well.
The RCN maybe be able to advise
