So under expectation II, deposited PhD theses from EPSRC funded studentships will need to include a citation with a persistent link to the data, or a statement detailing why access to the data is protected?

I have asked this question to the EPSRC last month - pasting below the reply I have received:
"Our position is that any researcher publishing their work should be able to provide the evidence to support their findings. If we have funded the work, and provided there are no legitimate reasons preventing the data from being made available, then yes, we would expect the data to be shared.
We would of course expect any Intellectual Property that might be embodied in the work to be suitably protected beforehand, and we would not expect data that is confidential to a third party to be released – recall the RCUK principle which states ‘Publicly funded research data are a public good, produced in the public interest, which should be made openly available with as few restrictions as possible in a timely and responsible manner that does not harm intellectual property’ - in other words we do not wish to see the research process damaged by premature and/or inappropriate release of research data!"

Sorry to resurrect an old thread!
I'm wondering whether anyone has received guidance from EPSRC as to whether a PhD thesis from a studentship would be considered to be a publication? (ours are deposited in the institutional repository and EThOS).
I'm assuming that theses would be considered to be for the purposes of examination rather than disseminating research - and that expectation II would only apply to papers published after completion?
Any thoughts gratefully received!
