I've got a site impacted with hydrocarbons, where undercroft garages form part of remediation/gas protection. My concern is to prevent the undercroft being converted into habitable space in the future. In theory it should be picked up by planning, however in practice this is a complex site and the details are buried in an array of reports that no one will ever have the time, (or inclination) to read again.
Has anyone managed to have a suitable requirement attached to the deeds as a covenant? If so how did you go about it, what evidence/proof did you require?
