I set up a similar funding mechanism where the capital allocations year on year from Central Government were effectively banked and rolled into one pot for Part II A investigations and remediation. We only spent money on operational costs such as setting up the administration for the regulatory function. Due to the significant budget cuts, that internal funding formula has now gone has is the pot of money that was saved. That pot mysteriously disappeared like magic. As is did budget. So It's good to see other Councils do the same but ratified through committee agreement. We have to use other reserves now when the proverbial hits the fan.

We are hoping that some LA's may follow suit.
There are a few caveats to the funding summarised below:
1. It is for residential land only that meets the criteria set out in our Fairness, Cost Recovery & Hardship policy.
2. The Council should prove beyond reasonable doubt that the land meets the statutory definition of Contaminated Land which should include obtaining agreement from the National Contaminated Land Expert Panel.
3. The Council should prove beyond reasonable doubt that there is no longer a Class A liable person who could be liable for the remediation works.
4. That the fund should only be used for remediation works e.g. excavation & disposal of contaminated materials, replacement with clean materials and basic reinstatement.

The article makes interesting reading and I just wondered if anyone was aware of any other councils that had taken such a strategic view of Part 2A inspections, I had assumed most would just soldier on hoping for the best.
