Have not undeclared a site but your second query will depend on your councils constitution and who it delegates the powers to, if anyone. If the power is delegated than it can be an officer decision (make note of section 7 of the new The Openness of Local Government Bodies Regulations 2014 http://www.legislation.gov.uk/uksi/2014/2095/regulation/7/made which cam in on the 6th august ) otherwise it would need to be at least a cabinet decision if not a full council decision.

There are to questions to this query:
Firstly, has any Local Authority reconsidered a determination that land is contaminated land and revoked the original determination notice?
If so, what format should the written statement take and if any Local Authority has a template, would they be willing to share it?
Secondly, in terms of the decision making; if it was a cabinet decision based on an Officer report to originally determine land as contaminated land, does the decision to revoke the determination have to be made by cabinet or can that decision be made by Officers?
