We have just heard from BB Support:
<< The error comes from the initial creation of the /internal/courses/[course_id]/attempt/ folder. Interestingly, looking deeper into the code I looks like this is not a new issue.
The issue can also be replicated on Sp12 and below, Its not a new issue in April2014.
Log in as system admin
Create a brand New course
Create a single New Assignment.
Submit the assignment simultaneously as multiple students.
You may see the error with one or more students.
The reason it’s not been reported widely before even though its been a bug for at least as far back as SP12 is that its needs these very specific set of circumstances to occur, which are quite unlikely to occur in a real course, but very likely in a testing environment.
If you test the following:
Create a brand New course
Create a single New Assignment.
Log in as one student and submit the assignment.
Submit the assignment simultaneously as multiple students.
Create another New Assignment.
Submit the assignment simultaneously as multiple students.
I don’t think you will see the error, because the /internal/courses/[course_id]/ and /internal/courses/[course_id]/attempt/ folder will be created as soon as the first student submits and assignment or assessment. From then on the issue will never happen again in that course because the folder structure has already been created.
So, in order to actually replicate this error you need to have a very unique set of circumstances, which is probably why it has not been reported before. It’s certainly not new to April2014 release.
We are currently working on a patch for this issue and will update you shortly. >>
I have tested as recommended above and the error was not triggered. I would still want to have a patch available before we upgrade in production but the risk of upgrading with the bug in place feels much less now.

Blackboard have advised to try with a new assignment, which we did. However, sadly, we have just replicated the issue with a new assignment in a new course; one of six accounts received the error.

We tried to replicate the issue this morning but couldn't (tried 4 times with 3 users).
We are on April 2014 CU1 and also have the grade centre patch installed (LRNSI-16942).

Thanks Meg, that's interesting. We installed the LRNSI-16942 grades patch on Tuesday to resolve the issue with not being able to upload to the Grade Center and now we're not able to replicate the assignment issue, having tested with both 3 and 6 users.
Has anyone else installed this patch since reporting the assignment issue? If so, has this resolved it for you as well?

We have the same set up as Tom and cannot replicate the problem - which I'm very happy about as we upgraded to APRIL 2014 this week!
Set Up: We're running Blackboard Learn Version 9.1.201404.160205 with LRNSI-16473 Cumulative update 1 & a LRNSI-16942 grades patch. We have Assignment building block 2.4.1096797 & all other related building blocks e.g. inline grading are up to date. We are managed hosting clients.
Test: Article No.: 000037653 (Could not Write to Private Store when Student Assignment Submissions are Submitted Simultaneously) Using 9 students we simultaneously submitted two file types: 42MB video and 1.5MB word document in to separate Blackboard assignment drop boxes.
No "Could not write to private store" error message was observed.
