We had a situation recently where a community group requested whether they could have blaes which was present on a derelict / abandoned council football pitch to surface a running track around their boys club football pitch. They were requesting to have the blaes FOC and they would transport it and place it on thir site.
Fom a CL perspective we decided to take a light touch on the basis it was essentially a like for like use with a continued use as a running track and it had been a blaes football pitch for 30 years with no ill effects and it didn't require a planning consent . We were cautious with regards the waste issue as it skirted with the topic.
As a Council, we had no plans to do anything with the site - it wasn't coming up for redevelopment, therefore we had no "intention to discard" the blaes so we thought it may not be a waste, therefore the community group wouldn't need excemptions etc.
For sureity, we ran the scenario past the SEPA waste team, who after consideration, agreed with out thoughts and decided the proposed scenario did not constitute a waste activity as ther was no intention to discard and the blaes could be re-used on another site without waste regulation.
