I've run a few. I'd suggest that a light touch approach which has common sense combined with managing expectations in advance is the best approach. Generally all hack days (unless they're put together by a commercial entity and developers are sponsored in some way or if the hack day is specifically contributing towards an open source project) have "your IP remains with you" clauses. In team situations this becomes harder to manage - probably verging on impossible to manage - but there's some good advice out there on the web.
