SYRACUSE -- A disabled mans claim of police brutality for refusing to sit down
on a Centro bus has emerged as a significant issue in the upcoming democratic
primary for Syracuse mayor.

Speaking at a news conference on equal rights, Syracuse City Councilor and
candidate for mayor, Pat Hogan told reporters, "I am appalled at what I saw."
.
Hogan was referring to surveillance video of a May 3rd incident in which Brad
Hulett, a severely disabled passenger, was tased and dragged off a Centro bus
by two Syracuse police officers, allegedly breaking his hip in the process.
Hulett was charged with resisting arrest and disorderly conduct.
.
The incident has sparked outrage among disabled and civil right advocates, as
well as a lawsuit against the City.

"If I was mayor, the police chief and officers would be in my office the next
day," says Hogan.
.
He accused the mayor and the police chief of being silent on the issue.

Surveillance video of what happened to Hulett on May 3rd has outraged many
people in Central New york. He refused a bus driver's order to sit down even
though the bus accomodates standing passengers. Syracuse Police Sergeant
William Galvin and Officer William Coleman were called in. Hulett continued to
refuse to sit down or leave the bus. He was tasered twice and dragged off the
bus apparently breaking his hip during the incident.

"The police tased him not once, but twice. Then they dragged him off the bus
and broke his hip. Are these people insane? For standing on the bus? This is
criminal." said Sally Johnston of Disabled in Action.

Hulett's supporters are calling for the immediate suspensions of the police
officers and a thorough investigation of their actions. They also want an
investigation into Hulett's treatment at the Justice Center Jail where they say
Hulett was forced to suffer with a broken hip overnight before receiving
medical treatment.

Brad Hulett, you deserved better.

And the public deserves answers.

Hulett is disabled. In 1991, when he was 12, he was hit by two trains, one
right after the other. Doctors had to remove a portion of his brain to save his
life. He has a large dent in the right side of his skull. The brain damage
caused weakness on his left side. Hulett's left hand is almost useless. It's in
a permanently curled position.
.
In a story by reporter John O'Brien we learned that three months ago Hulett was
arrested by city police after an incident on a Centro bus.

It was hardly a simple arrest.

A video from the bus' security camera shows the officers -- Sgt. William Galvin
Jr. and Officer William Coleman -- zapping Hulett with a Taser. It shows him
screaming in pain, falling into the officers' arms and being dragged off the
bus. Outside, the video shows Galvin grabbing Hulett's right foot and dragging
him along the pavement.

Hulett, 35, suffered a broken left hip. He was brought into the jail in a
wheelchair. In a video taken at the jail, a deputy asks Hulett if he can stand
up. Hulett says his left leg is hurt. The deputy tries to help him up, but
Hulett collapses back into the wheelchair. Later, two deputies hold Hulett
under the armpits as he stands and another deputy frisks him.

Hulett claims a jail nurse did an improper assessment of his condition,
resulting in him sitting in a cell overnight with a broken hip.

Hulett's experience is chilling.
.
We understand that Tasers, when used properly, are valuable tools. Any tool
that can help end a potentially violent situation without anyone getting killed
is a good thing. But this? This hardly seems like it was potentially a violent
situation. Indeed, the video suggests the only people escalating the situation
were the officers.

Hulett's arrest shows a lack of compassion and civility by police. At the jail,
there appears to be no evidence of competence. Why would anyone try to make a
man in a wheelchair stand? How could a nurse at the jail under a microscope for
its poor medical care interview Hulett and perform only a routine general
assessment, never asking him why he was in a wheelchair?

Syracuse, NY -- Onondaga County Sheriff Kevin Walsh offered no apologies today
for the way Brad Hulett, a disabled man with a broken hip, was treated in May
at the Justice Center jail.

In addition to the incident on the bus, Hulett is planning to sue the county
for his treatment at the jail.

A video showed Hulett in a wheelchair twice being forced to stand up and try to
walk through a metal detector. Hulett claims he was also improperly assessed by
a nurse and forced to stay in a cell overnight with a broken hip.

"You don't have all the facts," Walsh said when questioned today about Hulett's
treatment at the jail. "I am kind of restricted once people start talking about
lawsuits. What's being reported, at least from our involvement, is not
accurate."

But the sheriff said he could not offer more details because Hulett intends to
sue.

Inside the jail, a video shows deputies twice trying to get Hulett, who arrived
in a wheelchair, to walk through a metal detector. The first time, he crumples
back into the wheelchair. The second time, deputies frisk him while holding him
up.

Walsh suggested Hulett's lawsuit might be undeserving, but would not directly
defend the deputies' actions.

"Until such time as we know if this is going to result in a lawsuit, which it
may well, undeserving as it might be, I can't comment," the sheriff said.

The sheriff reiterated his "no comment" when asked specifically about the
footage recorded at the metal detector and Hulett's claims of improper medical
attention.

SYRACUSE, NY - Onondaga County prosecutors agreed to drop criminal charges
today against a disabled man tasered by Syracuse police because he wouldn't get
off a Centro bus in May.
.
City Court Judge Theodore Limpert granted a request by Assistant District
Attorney Jeff Schiano and defense lawyer Rick Guy to dismiss charges of
resisting arrest and disorderly conduct against Brad Hulett stemming from the
May 3 incident on a bus at Centro's hub in downtown Syracuse.
.
The district attorney's office agreed with Guy that there was insufficient
evidence to support the charges.
.
District Attorney William Fitzpatrick issued a news release after the
dismissal, saying his office was upholding its "legal and ethical obligations
to ensure justice."
.
"I am troubled by the video captured on the CENTRO bus," the release said. "I
am also concerned about inconsistencies in the police reports written in this
case."
.
In police reports and in the document charging Hulett, the officers said they
told Hulett he was under arrest on the bus before hitting him with the Taser.
But in a video of the incident, no such statement can be heard.

Schiano said he reviewed all the available evidence, including the bus video,
but found nothing to corroborate the officers' statements that they told Hulett
before tasering him that he was under arrest.

SYRACUSE -- The members of the Syracuse Common Council are promising to alter
the Syracuse Police Department's "Use of Force" policy after a man with
disabilities was tased and injured for refusing to sit down on a Centro bus.
.
Although councilors did not discuss the specifics of the May 3rd incident, the
council's Public Safety Committee held a special hearing on the broader issue
of how police use tasers in accordance with the department's policies and
procedures.
.
Brad Hulett attended the hearing but did not speak. Hulett intends to sue the
City of Syracuse after accusing two police officers of using excessive force
when they tased him. Surveillance video shows Hulett refusing the officers'
repeated commands to sit down even though the bus accommodates standing
passengers. Hulett is seen being tased and physically dragged off the bus. Once
outside, one of the officers is seen dragging Hulett away by one leg. Hulett
suffered a broken hip during the incident.

An internal review of the incident found that the officers use of the taser was
in accordance with the department's Use of Force policy.
