There isn't a way to place a RAM limit on this or any other process, and I'm very surprised that your system becomes unusable when it is only requiring a small amount of swap for a small amount of time. In general I'm not sure there's much point in trying to fix this problem just for fslmerge as whenever you use the resulting image in another process you will have exactly the same problems, if not worse. I think the only solution is to either work out why the use of swap causes such problems on your system, or to find a machine that is more suitable for analyses of this size.
