The Government has intimated that employers may, in principle, be able to overrule a doctor's advice in a fit note as to whether or not a patient is potentially fit to return to work.
The change was included in new guidance on the fit note published by the Government earlier this year and could allow employers to favour the views of an occupational health practitioner over those of a GP.
In the guidance, under the headline "Is the fit note binding on me?" the Government has confirmed that the answer could be "no".
They state that: "The assessment about whether your employee is not fit for work or may be fit for work (and any other advice in the fit note) is classed as advice, and it is for employers to determine whether or not to accept it.
Now there's a useful sentence...

That’s my point...
I am lucky if the manager has even completed the referral with any useful data to start with and as much as we encourage the manager to ensure the employee is informed they rarely are.
I find myself concerned that if I don’t tell them they won't know until the situation becomes an issue that this is a possibility.
I would prefer the manager to manage but as many of us know that is erratic at best.

Intresting discussion.
In an ideal world, the manager should have discussed the reason for the referral, the information being requested and importantly for this conversation how that information will be used. So in an ideal world the manager should have had that conversation with the individual before they get to us....but unfortunately we don't live in an ideal world.
